These Terms & Conditions ("Terms") govern your access to and use of the mobile games and apps published by Double Eagle Apps LLC ("Double Eagle Apps," "we," "us," or "our") — including Queens Count, Backgammon, Solitaire, Chess & Checkers, Poker, Dominate, Bad Bomb, Coin & Note Manager, Nomad, and Kathy's Weather (each, an "App," and together with our websites, the "Services"). By downloading, installing, or using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. License to Use Our Apps
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use our Apps on devices you own or control, for your personal, non-commercial use. This license is subject to these Terms and to the terms of the app store from which you obtained the App (such as the Google Play Store or the Apple App Store).
2. Eligibility & Accounts
Our Services are intended for users aged 13 and older (or 16 and older in the European Economic Area, where a higher age of digital consent applies). Most of our games can be played without an account. Where a Service offers or requires an account (such as the social features in Nomad), you agree to provide accurate information, to keep your credentials secure, and to be responsible for the activity that occurs under your account. Notify us promptly of any unauthorized use.
3. What You May Not Do
You agree not to:
- Copy, modify, distribute, sell, or lease any part of our Services;
- Reverse engineer, decompile, or attempt to extract the source code of any App, except where such restriction is prohibited by law;
- Use our Services in any way that violates applicable laws or regulations;
- Interfere with or disrupt our Services, servers, or leaderboards — including submitting falsified scores or otherwise manipulating gameplay;
- Access our Services through automated means, or attempt to gain unauthorized access to any account, system, or data;
- Remove or obscure any proprietary notices in our Services.
4. User Content & Community Standards
Some of our Services let you create, post, or share content, or interact with other people (for example, the social features in Nomad). You are solely responsible for the content you submit, and you retain ownership of it. By submitting content, you grant Double Eagle Apps a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content as needed to operate and provide the Service.
We maintain a zero-tolerance policy for objectionable content and abusive behavior. You agree not to post, transmit, or share content that is unlawful, harassing, hateful, threatening, sexually explicit, defamatory, or that infringes the rights of others. In Services that include user content, we provide tools to report objectionable content and to block abusive users. We review reports and may remove content or suspend or terminate accounts that violate these Terms — generally acting on reports of objectionable content within 24 hours. To report content or a user, use the in-app reporting tools where available, or email support@doubleeagleapps.com.
5. Intellectual Property
Our Services — including their gameplay, artwork, logos, sounds, music, and the "Double Eagle Apps," "Queens Count," and related names and marks — are owned by Double Eagle Apps and protected by copyright and other intellectual-property laws. Nothing in these Terms transfers any ownership rights to you, except for the limited license granted above.
6. Advertisements & Third-Party Services
Some of our Apps are free to use and supported by advertising. They may use third-party services — including Google AdMob, Google Analytics for Firebase, and Google Play Games Services — that are governed by their own terms and privacy policies. Your use of those services through our Apps is subject to their terms. How our Services handle data is described in our Privacy Policy.
7. Scores, Progress & Leaderboards
Game progress, statistics, achievements, and settings are generally stored locally on your device; uninstalling an App may permanently delete them. Some games let you submit scores to an optional leaderboard (for example, through Google Play Games Services). We may remove leaderboard entries we reasonably believe were obtained through cheating or manipulation.
8. Updates & Availability
We may update, change, suspend, or discontinue any of our Services — or any feature of them — at any time without notice or liability. Updates may be required for continued use. We are not obligated to provide any maintenance or support.
9. Disclaimer of Warranties
Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Double Eagle Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of (or inability to use) our Services. In no event shall our total liability to you for all claims exceed the amount you paid for the App giving rise to the claim (which, for a free app, is zero) or fifty U.S. dollars (US $50), whichever is greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Termination
These Terms are effective until terminated. Your rights under these Terms end automatically if you fail to comply with them; upon termination you must stop using our Services and delete all copies of our Apps. We may also terminate or suspend access to any account or online feature (such as social features or leaderboards) at any time, including for violations of these Terms.
12. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Effective date" at the top of this page. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms.
13. App Store Terms
Google Play. If you obtained an App from the Google Play Store, you acknowledge that your download and use of the App are also subject to the Google Play Terms of Service and the Google Play Developer Program Policies.
Apple App Store. If you obtained an App from the Apple App Store, the following additional terms apply:
- These Terms are an agreement between you and Double Eagle Apps only — not with Apple Inc. ("Apple"). Double Eagle Apps, not Apple, is solely responsible for the App and its content.
- Your license to the App is limited to a non-transferable license to use it on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (except as permitted by Family Sharing or volume purchasing).
- Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Double Eagle Apps, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar laws.
- In the event of a third-party claim that the App infringes intellectual-property rights, Double Eagle Apps, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms of agreement when using the App.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law principles. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
